04 · Scope and legal basis

What you should know

When substantiation of pricing adequacy is required
of the Chairman of the State Procurement Agency by Order No. 12 of 14 June 2017 In accordance with the amendment to the “Rules for conducting an electronic tender”, where the tender documentation provides for an obligation to substantiate pricing adequacy, the contracting authority requires the bidder to provide substantiation if the final price recorded as a result of the electronic bidding is lower by 20% or more than the estimated value of the procurement object.

A similar requirement is also common in the private sector in respect of contractor companies. Before publication, verify the version of the order currently in force.

What happens in the case of an adverse conclusion
In the case of an adverse result, the report specifies the particular non-conformities. The result is determined solely by the inspection — we do not give a favourable conclusion in advance.

Scope of services

  • The inspection result is based on the scope of assessment, the methods applied and the evidence collected.
  • The company does not perform the works it independently inspects, nor does it take part in the design of the facility.
  • Mandatory requirements are neither altered nor reduced by agreeing the scope of services.
  • An inspection does not imply a predetermined favourable conclusion and provides no guarantee of an administrative decision.
